REFUND POLICY

POKEMART EVENTS

VENDOR LIABILITY WAIVER, RELEASE OF LIABILITY, AND HOLD HARMLESS AGREEMENT

This Agreement is entered into between PokeMart Events (“Organizer”) and the undersigned Vendor (“Vendor”) participating in a PokeMart Events show.

1. ASSUMPTION OF RISK

Vendor understands and acknowledges that participation in a public event involves inherent risks, including but not limited to theft, loss of merchandise, property damage, personal injury, illness, accidents, and other unforeseen incidents. Vendor voluntarily assumes all risks associated with participation in the event.

2. VENDOR RESPONSIBILITIES

Vendor agrees to:

• Maintain a safe, clean, and professional booth space at all times.

• Be responsible for all merchandise, displays, equipment, cash, valuables, and personal property.

• Comply with all federal, state, and local laws, regulations, and licensing requirements.

• Conduct business in a professional manner that reflects positively on the event and hobby community.

• Be responsible for the actions of any employees, helpers, family members, or representatives working within their booth space.

3. RELEASE OF LIABILITY

Vendor hereby releases, waives, discharges, and agrees not to hold liable PokeMart Events, its owners, officers, employees, volunteers, sponsors, venue partners, contractors, and affiliates from any and all claims, demands, damages, actions, causes of action, liabilities, costs, or expenses arising out of or related to participation in the event.

This release includes, but is not limited to:

• Theft or loss of merchandise

• Damage to personal property

• Personal injury

• Illness

• Accidents occurring during setup, event hours, or teardown

• Financial losses related to participation in the event

4. HOLD HARMLESS AND INDEMNIFICATION

Vendor agrees to indemnify, defend, and hold harmless PokeMart Events, its owners, employees, volunteers, sponsors, venue partners, and affiliates from any claims, liabilities, damages, judgments, costs, expenses, or attorney fees arising from:

• Vendor’s actions or negligence

• Vendor’s products, merchandise, or services

• Injuries or damages caused by Vendor or Vendor’s representatives

• Violations of any applicable law or regulation

• Disputes between Vendor and customers

5. SECURITY DISCLAIMER

PokeMart Events may provide security personnel and safety measures; however, no guarantee of security is expressed or implied. Vendor understands and agrees that PokeMart Events is not responsible for lost, stolen, misplaced, or damaged property.

6. SALES AND PRODUCT RESPONSIBILITY

Vendor is solely responsible for all products sold, traded, displayed, or promoted at the event. Vendor warrants that all merchandise is legally owned or authorized for sale and assumes full responsibility for any disputes regarding authenticity, ownership, condition, refunds, exchanges, or warranties.

7. EVENT RULES

PokeMart Events reserves the right to remove any Vendor from the event without refund for:

• Unsafe conduct

• Illegal activity

• Harassment of attendees, vendors, or staff

• Misrepresentation of merchandise

• Violation of event policies

• Any behavior deemed detrimental to the event

8. PHOTO AND VIDEO RELEASE

Vendor grants PokeMart Events permission to photograph, record, and use images or video of Vendor, Vendor’s booth, and displayed merchandise for promotional, advertising, marketing, and social media purposes without compensation.

9. AGREEMENT

By purchasing a vendor table, Vendor acknowledges that they have read, understood, and voluntarily agree to all terms contained in this Vendor Liability Waiver, Release of Liability, and Hold Harmless Agreement.
